The photographer processes your personal data in compliance with the provisions of the General Data Protection Regulation (GDPR).
In this information the photographer advises you in a transparent manner of the type, scope and purpose of the personal data collected by the photographer and of your rights as data subject.

1. Who collects your data?

collects your personal data as the controller responsible (Art. 4 (1) no. 7 GDPR).

2. Which sources are used for the collection of personal data?
The photographer collects and processes personal data which are obtained directly from the photographer’s contract partners, cooperation partners and other business partners in the course of the photographer’s business relationships.(4)
In addition, the photographer processes personal data which are lawfully obtained from publicly accessible sources (e.g. registers of companies and associations, the press, media, the Internet) and which the photographer is therefore allowed to use.(5)

3. Which data are collected?(6)
The personal data collected by the photographer include contact data of contract partners.
If a contract, cooperation, collaboration or any other exchange is being prepared which is initiated by a personal exchange or an exchange on the telephone or in writing by you or the photographer, then personal data also become known, e.g. information on the contact channel, the date, occasion and result,(electronic) copies of the correspondence etc.

4. What is the purpose of the data collection?
The data are collected and processed for the purpose of initiating steps preceding a contractual business relationship prior to entering into a contract and to perform the contract.(7)
Your personal data are collected for the purpose of performance of the contract, of the contractual obligations and of steps prior to entering into a contract. The provision of your data is necessary in connection with the obligations prior to entering into a contract, for example to prepare and send you a cost estimate. Without these data it is impossible to enter into the contract.(8)

Furthermore, the purposes of the data processing ensue from statutory obligations, e.g. statutory retention periods and obligations to submit evidence to the tax authorities.(9)
In addition, the purpose of the data processing can be based on the legitimate interests of the photographer or third parties. This is the case if your interests, fundamental rights and freedoms do not override the interests of the photographer. The legitimate interest of the photographer lies for example in pursuing his/her business interests.(10)
Otherwise, your personal data shall only be collected and processed by the photographer if you have given your explicit consent to this.(11)

5. What is the legal basis for the data processing?(12)
Your personal data shall be processed in compliance with the General Data Protection Regulation (GDPR):
Insofar as your data are processed as a result of the conclusion and execution of a contract, then the basis is Art. 6 (1) b) GDPR.
Insofar as your data are processed due to statutory obligations, then the basis for this is Art. 6 (1) c) GDPR.
Insofar as your personal data are processed as a result of the legitimate interests of the photographer or third parties, then the basis for this is Art. 6 (1) f) GDPR.
Insofar as the photographer processes your personal data as a result of your consent, then the basis for this is Art. 6 (1) a) GDPR.

6. Will your data be transferred to third parties?(13)
In performance of the contract entered into with you only those entities which require the data for statutory reasons, e.g. tax authorities, will receive the data provided by you.

7. How long will your data be processed for?(15)
If the data processing by the photographer is based on the conclusion of a contract, then your personal data will be erased as soon as they are no longer required for the performance of the contract or to achieve the purpose of the contract.

If the data processing by the photographer is based on his/her legitimate interests or on interests of third parties, the data shall be processed for as long as the legitimate interests continue to exist and you have not objected to the data processing.
If the data processing is based on your consent, then the data shall be processed by the photographer as long as you have not withdrawn your consent.

8. What are your rights as data subject?
You have the right to obtain from the photographer information (Art. 15 GDPR) on the data stored on you and, if the data have any inaccuracy, to obtain rectification (Art. 16 GDPR) and in the event of unlawful storage of the data, subject to the requirements of Art. 17 GDPR, to obtain the erasure of your data. You can obtain the restriction of the processing of your data subject to the requirements of Art. 18 GDPR.
In addition, you have the right to data portability, i.e. you can request receipt of the data provided by you from the photographer in a structured, commonly used and machine-readable format (Art. 20 GDPR).(16)
Furthermore, you have the right to lodge a complaint (Art. 77 GDPR) with the supervisory authority.(17)
If the data are processed on the basis of legitimate interests of the photographer, you have the right, subject to the requirements of Art. 21 GDPR, to object to the processing of your personal data at any time. (18)
If the data processing is based on consent given by you, you have the right to withdraw such consent at any time and without stating any grounds (Art. 7 GDPR).(19)
